Qualifikationsziele
By the end of the course, students will be familiar with the main principles, legal tools and legal concepts that underpin the special legal regime of international environmental law (IEL). This legal regime will have been scrutinized as a ‘branch’ of international law, with its own institutions, actors and legal sources. Specific sub-specialized regulatory regimes of IEL will have been addressed (i.e. the hydrosphere, the atmosphere and the biosphere) to offer students an overview of the different regulatory fields that form part of the overarching regime of IEL. Thereby, students should be able to conceptualize the broad substantive scope of protection that IEL implements and be familiar with the challenges this raises. The enforcement of these various fields of IEL will also be addressed, with particular attention paid to questions of adjudication and compliance with international environmental protection laws.

Kommentar/Beschreibung

This course provides an introduction to international environmental law. The course is divided into three main sections: (I) the foundations of international environmental law (i.e. historical developments, challengesm actors, sources of law, principles of IEL); (II) the 'horizontal', i.e. cross-cutting, substantive rules of international environmental law (i.e. envronmental information, environmental impact assessment, liabilitym enforcement); (III) the 'sectroal' substantive rules of international environmental law which apply to specific environmental, challenges, goods or regions (i.e. climate change, air pollution, ozone depletion, freshwater resources, habitats, biodiversity, hazardous substances, waste, polar regions).
